@BenjamimWillard It's a complex area of civil and criminal law when it comes to landowner liability in these cases.
There's no yes/no answer: there is certainly some risk to public bodies and private landowners in such cases. The case taken by BCC against DfI demonstrated that.

@hand_oul @Maceroni2000 We amended it as it was unworkable (a Council can't regulate something that is illegal) and directed it to Stormont to address as part of the FICT report. I wrote to other ministers repeatedly about that, but the DUP blocked publication of an action plan.
@noraa642 I happen to think letting a family grieve in peace is the right thing to do. It won't deflect us from raising this issue and seeking a solution once that period has passed.

@BrianRocks1964 @SeanIreland123 You really can't. Building the fire may require some skill, but the sectarian, misogynistic, hate-filled trappings aren't culture of any kind.

In this case, the direct threat on display has been reported to the police.
@1057Seamus It's mainly a civil rather than a criminal matter: it relies on the property owner taking action to clear the site. Given the level of threat, that often proves impossible.
@9C0UNTYULSTER Actually, we don't ignore it between summers. But the opportunity to take action provided by the FICT report was squandered, as no political agreement was possible on the way forward. I'm as frustrated as everyone else about that.
@EdithVanHopper1 @ciaranconroy17 @JulieACorr @BBCNewsNI I doubt it will be officially recognised given bonfires are illegal: I also doubt anyone would want to encourage the building of such hugely dangerous pyres.
@DidntU2 @StephenFarryMP I worked with Seamus for years as did Stephen: he was often critical of the government of the day and they weren't half as awful as the current incumbents.
He would have differed with your assessment btw: we were friends and he always encouraged and supported me.

@somaticon @MrRCain2 @kevinpbreslin Which is why we didn't support the motion and intead said that we needed Executive action on this issue NI-wide. You cannot regulate something that is fundamentally illegal.
